Terms & Conditions for Students
These terms explain the responsibilities, payments, learning conditions and service boundaries that apply when a student enrols in an ETMark Academy programme.
Regular attendance, respectful conduct, timely assignments and responsible use of course platforms and learning material are expected.
ETMark provides training and career support, but employment, income, business outcomes and third-party opportunities cannot be guaranteed.
These Student Terms and Conditions form an agreement between ETMark Academy (“ETMark”, “we”, “our” or “us”) and the enrolled student. Where the student is under 18, the parent or lawful guardian accepting the admission is also responsible for compliance. A programme brochure, admission confirmation, invoice, scholarship letter, instalment plan or other written course-specific document may contain additional terms. If there is a conflict, the most specific written term shared for that programme will apply, subject to rights that cannot lawfully be excluded.
01 / Acceptance
Acceptance and scope
These terms apply when a student applies for, pays for, enrols in or participates in an ETMark Academy course, workshop, bootcamp, internship-linked programme, corporate learning programme or related educational service.
By completing enrolment, making a payment, accessing course materials or attending a session, the student confirms that they have read and accepted these terms and any written programme-specific conditions.
02 / Student information
Eligibility and accurate information
Students must provide complete and accurate information during enquiry, admission, payment and certification. This may include name, age, contact details, education, employment status, identity details and any information reasonably required for programme delivery.
- A student must meet any age, academic, language, device or prerequisite requirements stated for the programme.
- A minor must enrol with the knowledge and consent of a parent or lawful guardian where required.
- ETMark may ask for supporting information before confirming admission, scholarship eligibility, internship participation or certification.
- False, misleading or impersonated information may result in rejection, suspension or cancellation of enrolment.
03 / Enrolment
Admission, batch allocation and seats
Admission is subject to seat availability, eligibility, payment completion and any other criteria communicated for the programme. ETMark may limit batch size and may close admissions when capacity is reached.
Batch dates, timings, trainer allocation and delivery mode are confirmed through the admission communication and may depend on minimum enrolment.
Duration, syllabus, inclusions, access period, instalments, certificate criteria and career-support benefits may differ between programmes.
ETMark may refuse admission where a programme is unsuitable for the applicant, required information is not provided, a payment fails, or prior conduct creates a reasonable safety, integrity or operational concern.
04 / Payments
Fees, instalments and taxes
- Programme fees and payment deadlines are those stated in the invoice, admission confirmation, offer or instalment plan.
- A seat may remain provisional until the required registration fee, deposit or first instalment is received.
- Students must pay instalments on time. Delayed payment may result in paused access to classes, materials, assessments, certificates or other services.
- Any applicable tax, transaction charge, bank charge or payment-gateway fee will be handled as stated at the time of payment.
- Scholarships, discounts and promotional prices apply only where confirmed in writing and cannot normally be combined unless expressly allowed.
Payment receipts should be retained by the student. ETMark is not responsible for money transferred to an unauthorised person, unofficial account or third party not confirmed through an official ETMark communication channel.
05 / Cancellations
Cancellation, refund, deferment and transfer
Any programme-specific refund or cancellation policy shared in writing at enrolment will apply first. Unless a different written policy is provided:
- A stated registration or seat-booking amount may be non-refundable where it has been identified as such before payment.
- A cancellation request must be submitted in writing from the student’s registered email address or phone number.
- After a programme has begun or substantial digital material, platform access or services have been provided, fees are generally non-refundable except where required by applicable law or expressly approved in writing.
- A request to move to a later batch, transfer a seat or change a programme is subject to availability, academic suitability and written approval. Administrative or fee differences may apply.
- Absence, change of mind, relocation, employment changes, device issues or failure to complete the course do not automatically create a refund entitlement.
If ETMark permanently cancels a paid programme and does not provide a suitable replacement, the student may be offered a transfer, credit or refund for the undelivered portion, as appropriate.
06 / Delivery
Programme schedules and delivery changes
Programmes may be delivered in person, online, in a blended format, through live sessions, recorded lessons, projects, assessments or supported self-learning. The format stated for the programme will apply.
ETMark may reasonably change a trainer, classroom, session date, timetable, sequence of modules, software tool, learning platform or delivery method where needed for academic quality, safety, technology, trainer availability or operational reasons. Where a significant change occurs, reasonable notice and an alternative arrangement will be provided where practical.
Public holidays, examinations, institutional events, weather, illness, internet outages or other circumstances may require rescheduling. A rescheduled session is considered part of the programme delivery.
07 / Participation
Attendance, assignments and learning responsibility
Students are responsible for active participation and for completing the work needed to benefit from the programme.
- Attend sessions on time and meet any minimum attendance requirement communicated for the programme.
- Complete assignments, projects, assessments and feedback activities within the specified timelines.
- Inform the academy promptly about prolonged absence or a genuine difficulty affecting participation.
- Arrange a suitable device, internet connection, software access and learning environment where these are required.
- Review missed material and use available support channels; repeated classes or one-to-one make-up sessions are not guaranteed.
A student who misses sessions remains responsible for the syllabus and may become ineligible for a certificate, internship referral or other completion benefit if attendance or assessment criteria are not met.
08 / Conduct
Respectful and professional behaviour
Students must maintain a safe, inclusive and professional learning environment. The following are not permitted:
- Harassment, bullying, discrimination, intimidation, threats or abusive behaviour.
- Disruption of classes, repeated misconduct or refusal to follow reasonable trainer or safety instructions.
- Cheating, plagiarism, impersonation, falsified work or unauthorised assistance in assessments.
- Sharing another person’s private information, screenshots, messages or recordings without permission.
- Using academy systems for unlawful, harmful, deceptive or unauthorised commercial activity.
- Damaging property, software, equipment, accounts or learning resources.
Concerns should be reported promptly to an ETMark team member. ETMark may investigate and take proportionate action while respecting confidentiality as far as reasonably possible.
09 / Completion
Assessments, certificates and academic integrity
Certificate eligibility may depend on attendance, fee completion, assignments, projects, assessments, conduct and other programme-specific criteria. Participation alone does not guarantee successful completion or certification.
Certificates may be withheld until outstanding fees, documentation, assignments or academic-integrity concerns are resolved. ETMark may correct an administrative error in a certificate and may revoke a certificate obtained through fraud, impersonation or serious academic misconduct.
Student work may be reviewed using reasonable plagiarism, originality or AI-use checks. The permitted use of AI tools may vary by assignment and must follow trainer instructions.
10 / Intellectual property
Course materials and permitted use
Course notes, videos, slides, templates, frameworks, exercises, assessments, recordings, brand assets, website content and other materials supplied by ETMark or its trainers are protected content and remain the property of their respective owner.
- Students receive a limited, personal, non-transferable right to use course material for their own learning.
- Materials may not be copied, resold, uploaded publicly, shared with non-enrolled persons, republished, translated for distribution or used to create a competing course without written permission.
- Login credentials, paid links and platform access must not be shared.
- Third-party software, templates and media remain subject to their own licences and usage rules.
Students retain ownership of original work they create, subject to third-party rights and any specific written project agreement. The student is responsible for ensuring that submitted work does not infringe another person’s copyright, trademark, privacy or confidentiality.
11 / Media
Class recordings, photographs and testimonials
ETMark may record selected online or classroom sessions for learning, attendance, quality, security or internal review. Students must not independently record or publish classes, trainers or other students without permission.
Photographs, videos, student work, testimonials or success stories will be used for public marketing only where appropriate permission has been obtained or where participation in a clearly identified public event reasonably involves such recording. A student may contact ETMark to withdraw consent for future optional promotional use, subject to material already lawfully published or required for recordkeeping.
12 / Technology
Online accounts, software and third-party platforms
Programmes may use third-party tools such as video-conferencing services, learning platforms, analytics tools, design tools, AI services, advertising platforms and cloud software. Their availability, features, pricing and terms are controlled by the relevant provider.
- Students must follow the third-party platform’s own terms and acceptable-use rules.
- ETMark does not control service interruptions, feature changes, account decisions or data practices of independent providers.
- Students should protect passwords, use secure devices and avoid entering confidential client or personal data into tools unless authorised.
- Paid third-party subscriptions are included only when specifically stated in the programme offer.
13 / Career support
Internships, placement assistance and outcomes
Where included, career support may involve portfolio guidance, interview preparation, job-search training, internship information, employer introductions, referrals or access to opportunities. These services support the student’s search but do not create an employment guarantee.
Employment, salary, promotion, freelance income, business growth, advertising performance and other outcomes depend on the student and external market factors.
The student remains responsible for applications, interviews, accurate representations, employer checks, work quality and acceptance of any offer.
Any internship, employer or client is an independent third party unless ETMark expressly states otherwise. Their selection, working conditions, compensation and continuation decisions are outside ETMark’s direct control.
14 / Enforcement
Suspension, removal or termination
ETMark may issue a warning, restrict access, move a student to another batch, suspend participation or terminate enrolment where reasonably necessary because of:
- Non-payment or repeated failure to follow the agreed instalment plan.
- Serious or repeated misconduct, harassment, threats or safety concerns.
- Cheating, impersonation, piracy, unauthorised sharing or misuse of systems.
- False information or unlawful activity.
- Conduct that materially disrupts learning or harms ETMark, its staff, students, partners or property.
Where appropriate, the student will be informed of the concern and given a reasonable opportunity to respond. Immediate action may be taken where there is a serious safety, legal, security or integrity risk. Refund eligibility following termination will depend on the circumstances, the services already delivered, the written programme policy and applicable law.
15 / Responsibility
Liability and responsible use
ETMark will use reasonable care in delivering the programme described in the admission communication. However, learning results vary and depend on attendance, effort, prior knowledge, practice, assessment performance and external conditions.
To the extent permitted by law, ETMark is not responsible for indirect or consequential loss, lost opportunities, lost profit, third-party decisions, internet or device failure, misuse of course information, or action taken by a student without appropriate professional, legal, financial or technical advice.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct or other non-excludable obligations.
16 / Privacy
Personal information
ETMark handles personal information in accordance with its Privacy Policy. Students must also respect the privacy and confidentiality of trainers, staff, classmates, clients, employers and project partners.
A student should not share passwords, confidential business information, customer data or another person’s personal information in assignments, public portfolios or AI tools unless they have proper authorisation.
17 / Events beyond control
Force majeure and unavoidable disruption
ETMark will not be responsible for delay or failure caused by events reasonably beyond its control, including natural disasters, severe weather, epidemic or public-health restrictions, government action, civil disturbance, transport disruption, power or internet failure, cyber incidents, building restrictions, platform outages or trainer emergencies.
Where practical, ETMark may reschedule sessions, change the delivery mode, extend access or provide a reasonable alternative instead of cancelling the programme.
18 / Updates
Changes to programmes or these terms
ETMark may update these general terms to reflect changes in its services, technology, academic processes or legal obligations. The current version will be published on this page with an updated date.
Changes that materially affect an already-enrolled student will be communicated through an appropriate channel and will not retrospectively remove a right that has already accrued under applicable law or a confirmed written agreement.
19 / Governing terms
Law, complaints and disputes
These terms are governed by the laws of India. Students should first raise any concern with ETMark using the contact details below so that the academy has a reasonable opportunity to review and resolve it.
If a dispute cannot be resolved informally, the parties may use any dispute-resolution process agreed in writing or pursue remedies available under applicable law. Subject to mandatory consumer or other jurisdictional rights, courts with jurisdiction over Mysuru, Karnataka will have jurisdiction.
If any part of these terms is held invalid or unenforceable, the remaining parts will continue to apply. A delay in enforcing a term does not amount to a permanent waiver of that term.
